Conservative watchdog group America First Legal unearthed a secret Obama memo that could torpedo Jack Smith’s claims that President Trump didn’t have the authority to possess or retain classified documents.

In June Jack Smith indicted Trump on 37 federal counts for storing classified documents at his Mar-a-Lago residence.

Trump was charged in a federal court in Florida with 31 counts of willful retention of national defense information and 6 other process crimes stemming from his conversations with his lawyer.

In July Jack Smith hit Trump with 3 additional charges in a superseding indictment in the investigation into classified documents stored at Mar-a-Lago.

Last week AFL filed a FOIA request against the Defense Department for more information on a secretive committee created by Barack Obama

In 2014 Obama created the secretive Presidential Information Technology Committee (PITC) after Russian hackers breached the Executive Office of the President’s network.

“Special Counsel Jack Smith’s indictment against former President Trump, claims “Trump was not authorized to possess or retain…classified documents.” But Obama’s PITC memo may have created a reasonable belief in President Trump that he, in fact, had such authority,” America First Legal said.

“Unlocking this secret of the Obama presidency is not only important for public transparency, it has clear implications for whether the government may have failed to disclose necessary information to the defendant as part of its prosecution of former President Trump – and this information may significantly affect the evidentiary support relied upon in indicting and continuing to prosecute a former President. The American people deserve to know the truth behind this secretive memo and how it has been used,” said America First Legal’s Dr. Dan Epstein.

Via America First Legal:

In October 2014, Russian hackers breached the Executive Office of the President (EOP)’s network. In response, President Obama created, via executive action, PITC. PITC includes representatives of the Departments of Defense and Homeland Security, among others.

Why is the committee relevant today? 

First, PITC creates a presumption that the President controls all information he receives. The PITC memo established the President’s exclusive control over information resources and systems provided to the President. (§ 1, ¶ 2.). The memo created the presumption that information contained on information systems and resources was “EOP information.” ( § 4(f)). Because the memo relied upon the Federal Records Act’s definition of “information system” as resources organized for the “use” and “disposition” of “information”, the memo gives the President exclusive control over information he receives. This is relevant to what a President may reasonably believe about information given to him while in office.

Second, and related, if information stored on the PITC network formed the basis for Special Counsel Jack Smith’s prosecution of former President Trump, that evidence should have been disclosed to the former President and may be relevant to his liability.   

Special Counsel Jack Smith’s indictment against former President Trump, claims “Trump was not authorized to possess or retain…classified documents.” But Obama’s PITC memo may have created a reasonable belief in President Trump that he, in fact, had such authority. Additionally, if the records Trump allegedly destroyed are still preserved within the EOP or the U.S. Department of Defense as part of PITC-created information systems, then other claims in the indictment may be baseless.  

These explosive findings are consistent with America First Legal’s whitepaper contending that the President of the United States has absolute authority over presidential papers. Neither Congress nor the federal courts may lawfully abrogate or limit this authority.

 French President Macron and Prime Minister Attal try to deal with the farmers’ revolt.

While President Emmanuel Macron hops around the world looking for some positive agenda – first in India, and now in Sweden – France is still reeling with the revolt od the farmers.

The biggest European agricultural producer has been brought to a halt as farmers lay siege to the capital Paris, while the young and inexperienced new Prime Minister Gabriel Attal tries to keep it together.

In his latest attempt at appeasement, Attal said he is implementing controls on foreign food products in order to guarantee ‘fair competition’ amid farmers’ protests.

Associated Press reported:

“In his general policy speech at the National Assembly, Gabriel Attal told lawmakers ‘the goal is clear: guaranteeing fair competition, especially so that regulations that are being applied to (French) farmers are also respected by foreign products’.

He also said food retailers who don’t comply with a law meant to ensure a fair share of revenues for farmers will be fined, starting immediately. ‘We need to listen to the farmers, who are working and are worried about their future and their livelihood,” Attal said’.”

The farmers’ protest has been going on for days, asking for better remuneration for their produce, less red tape, protection against cheap imports and an end to insane, crippling green regulations.

They camped at barricades around Paris, broadcasting their case that growing and rearing food has become too difficult and not sufficiently lucrative.

“The farmers’ campaign for better pay, fewer constraints and lower costs has blown up into a major crisis for Attal in the first month of his new job. Protesters rejected pro-agriculture measures that Attal announced last week as insufficient. The government promised more responses would be forthcoming Tuesday.”

Hundreds of tractors, trailers and even rumbling harvesters came out to besiege Paris.

They came with reserves of food, water and tents to stay at barricades if the government doesn’t cave.

The French government deployed 15,000 police officers to stop any effort by the protesters to enter the capital.

Officers and armored vehicles were also stationed at Paris’ hub for fresh food supplies, the Rungis market.

Farmers are trying to get the message across about the cost and bureaucratic burden of maintaining ‘organic methods’ while competing with other countries with lower labor regulation costs.

“French farmers assert that higher prices for fertilizer, energy and other inputs for growing crops and feeding livestock have eaten into their incomes. Protesters also argue that France’s massively subsidized farming sector is over-regulated and hurt by food imports from countries where agricultural producers face lower costs and fewer constraints.”

Angry about rising costs, EU environmental policies and cheap food imports, Belgian farmers also revolted and blocked access roads to the Zeebrugge container port on Tuesday.

Reuters reported:

“A port authority spokesman said protesters had blocked five roads to trucks, but were letting cars through. He said it was not yet clear what the consequences on the operations of the port would be, and the port was indirectly in touch with the organizers through the police.

[…] Belgian farmers also disrupted traffic during the morning rush hour on Tuesday. One of the blockades was close to the Dutch border on the E19 highway, media said.”

Prime Minister Alexander De Croo was to meet with farmers’ associations today.

“A group of farmers blocking a square in central Brussels with tractors said they would stay put until at least Thursday, when EU government leaders meet in the city.

‘We are asking them to review their laws’, said Nicolas Fryers, a farmer at the protest. ‘They talk about being greener but if that happens then there will be land which isn’t worked anymore and it’s difficult enough as it is’.”

Israel’s Defense Minister, Yoav Gallant, stated on Monday that the country’s ground troops will take action “very soon” along the Lebanese border. The Israeli offensive comes as exchanges of gunfire between Israelis and Hezbollah intensify, escalating the risks of a direct confrontation in the region.

In a video released by the Ministry of Defense, Mr. Gallant declared:

“We have strengthened our positions in the North, and we will gradually release reservists so they can prepare and be ready for the upcoming actions. And very soon, they will be sent into action.”

The Defense Minister’s statements coincide with at least 12 Hezbollah attacks recorded against Israeli positions on the same day. At least three shots landed in open areas near Kiryat Shmona, according to the Israeli Army.

In response, a Hezbollah observation post and other group infrastructures were targeted, as confirmed by the Israeli military.

Since the October 7 attacks by the Hamas terrorist group against Israel, resulting in approximately 1,200 deaths, the Lebanese political-military group Hezbollah, also supported by Iran, has been firing rockets and artillery into Northern Israel.

These actions are considered acts of solidarity with the Palestinian organization. In retaliation, Israel has also launched its own attacks on positions within Lebanon in response to the acts of terror committed by Hezbollah.

Fulton County DA Fani Willis’ lover Nathan Wade asked for a protective order after a judge unsealed his divorce records.

Nathan Wade’s estranged wife Jocelyn Wade fought to unseal and make public their divorce records.

Last Monday a Cobb County judge granted a motion to unseal the top Trump prosecutor Nathan Wade’s divorce records.

Judge Henry R. Thompson last week also issued a stay on Fani Willis’ deposition…for now. Willis previously tried to quash the subpoena. She was supposed to give a deposition last Tuesday.

Jocelyn Wade’s attorney told the judge last Monday that her client wants Fani Willis’ deposition *not as a Fulton County DA* but as “the alleged paramour of my client’s husband.”

“I have questions and she needs to answer them,” Jocelyn Wade’s lawyer said in blistering remarks to the judge last week.

As previously reported, Fani Willis had an ‘improper’ romantic relationship with Nathan Wade, a top Trump prosecutor in her office.

According to the Atlanta Journal-Constitution, Fani Willis “financially benefited” from a romantic relationship with Nathan Wade, a top prosecutor she hired to go after President Trump.

In August Fulton County District Attorney Fani Willis hit President Trump and 18 others with RICO and conspiracy charges for daring to challenge the 2020 election.

The motion was filed in the Superior Court of Fulton County on behalf of defendant Michael Roman, a former Trump campaign official who was hit with counts 1, 9, 11, 13, 15, 17, 19 in Fani Willis’ RICO case.

The motion seeks to have the charges against Michael Roman dismissed and for Fani Willis, Nathan Wade and everyone in the DA’s office to be disqualified from the RICO case against Trump.

The filing claims Nathan Wade, the special prosecutor hired to go after Trump, paid for luxury vacations he took with Fani Willis to Napa Valley and a cruise in the Caribbean – and used money from Fulton County to pay for their out-of-town escapades.

“County records show that Wade, who has played a prominent role in the election interference case, has been paid nearly $654,000 in legal fees since January 2022. The DA authorizes his compensation.” the Atlanta Journal-Constitution reported.

Nathan Wade’s Capital One credit card statements provided by Jocelyn Wade were documented in the court filing reviewed by The Gateway Pundit.

Nathan Wade spent money on Fani Willis by buying her flowers, and paying for hotels, air travel, a cruise, and Ubers.

The bank statements prove Nathan Wade bought Fani Willis flights to Miami and San Francisco.

Last week Trump joined Michael Roman’s effort to disqualify Fani Willis from the RICO case in a 6-page court filing reviewed by The Gateway Pundit.

Trump’s attorneys accused Fani Willis of violating Georgia’s ethics rules by publicly accusing the defendants in the RICO case of racism after they called out her illicit affair.

There will be a hearing as early as February to look into Fani Willis’ relationship with Nathan Wade.
