A federal judge is also threatening to punish imprisoned January 6 defendants by adding enhancements to remaining convictions if the US Supreme Court reverses the ‘obstruction’ statute.
The US Supreme Court recently announced it will hear oral arguments in Fischer v. United States and at issue is statute 18 USC §1512(c)(2):
Whoever corruptly—
(1) alters, destroys, mutilates, or conceals a record, document, or other object, or attempts to do so, with the intent to impair the object’s integrity or availability for use in an official proceeding; or
(2) otherwise obstructs, influences, or impedes any official proceeding, or attempts to do so, shall be fined under this title or imprisoned not more than 20 years, or both.
The Supreme Court is expected to issue a decision on Fischer v United States this summer which means hundreds of J6 cases could be upended.
Biden’s corrupt DOJ has charged more than 300 J6ers with 18 USC §1512(c)(2). Additionally, two of the four charges against Trump in Jack Smith’s DC case are conspiracy to obstruct so the Supreme Court’s ruling could torpedo the special counsel’s case against Trump as well.
Last week US Attorney from DC Matthew Graves fired a warning shot to the US Supreme Court – and J6ers serving time for 18 USC §1512(c)(2), the ‘obstruction’ statute pending before SCOTUS.
US District Judge for the District of Columbia Tim Kelly, a Trump appointee, is also threatening to add enhancements to remaining convictions if 1512c2 is reversed by the Supreme Court.
Judge Kelly threatened J6 defendant Gilbert Fonticoba, who was recommended a 62-month jail sentence for entering the Capitol building for 3 minutes.
The judge said he will add time to Fonticoba’s sentence if the Supreme Court reverses the ‘obstruction’ statute.
Judge Kelly ultimately sentenced Fonticoba to 48 months for the 1512c2 conviction.
Fonticoba asked Judge Kelly to delay his reporting to federal prison on April 12 pending SCOTUS decision on 1512c2.

As The Gateway Pundit previously reported, investigative reporter Lara Logan reported that the crash of the Dali cargo ship into the Francis Scott Key Bridge in Baltimore was not an accident but rather a “strategic attack.”
Hours after the Dali cargo ship crashed into the Key bridge, taking the lives of six men, the Democrat Governor of Maryland, in a press conference, stated, “The preliminary investigation points to an accident. We haven’t seen any credible evidence of a terrorist attack.”
Many believed Moore and the NTSB’s quick assessment to rule out terrorism raised red flags, considering the NTSB’s preliminary analysis of the Dali’s VDR (Black Box) was yet to be revealed.
The Biden administration has been preparing for possible cyber security attacks on U.S. ports in recent months.
In February, Biden signed an executive order that aimed to “To bolster the Department of Homeland Security’s authority to directly address maritime cyber threats, including through cybersecurity standards to ensure that American ports’ networks and systems are secure.”
The executive order stated its main objective was to “improve maritime cybersecurity and supply chain security.”

While Baltimore and the nation are dealing with the collapse on Tuesday of the Francis Scott Key Bridge in Baltimore Harbor following the allision of the Dali cargo ship into a support beam that resulted in the blocking of a major port and hazmat/commuter route (I-695), open borders advocates and some in the media are weaponizing the tragic deaths of the six road workers killed in the incident to score political points.
A crew of eight men filling potholes on the bridge were reportedly on a break in their cars parked on the bridge when the Dali struck at 1:27 a.m. EDT. One of the victims is said to have lived in the United States for 19 years, another for 17 years, however all six have been referred to in press reports as ‘migrants’ or ‘immigrants’ from Mexico, Guatemala, El Salvador and Honduras. The immigration status of the men has not been generally reported, however Voice of America reported one entered the U.S. illegally.
Of the two workers who survived and were rescued soon after the bridge fell, one was hospitalized and has since been released, while the second is reported to have refused being taken to the hospital. Two bodies have been recovered and four are still missing.

A common theme used by advocates was that the immigrant workers died doing a job that Americans will not do.

…Six people were killed Wednesday afternoon in a crash on the westside of the Baltimore Beltway in Woodlawn.
According to Maryland State Police, troopers were called around 12:40 p.m. for reports of a pedestrian struck at a work zone on the Inner Loop of the Beltway near Security Boulevard.
Gustavo Torres, executive director of the Maryland based pro-illegal immigration group CASA spoke to NPR host Debbie Elliott about the challenges immigrants, legal and illegal, face and urged Joe Biden to pass amnesty (excerpt):
ELLIOTT: You know, the U.S. Bureau of Labor Statistics estimates that up to a third of construction workers in 2020 were Hispanic, and many are foreign-born, and that they are at particular risk of fatal injuries because of the type of work that they do. How does this show up in the challenges that workers in your group face?
TORRES: Yeah, that is really, really a reality. In particularly the Washington, D.C., and Baltimore metro area, we have around 130,000 immigrants who work in this essential work. And we see – all the time see these kind of accidents. In fact, almost a year ago to the date of the bridge collapse and also on the 695 highway, six highway construction workers, half of them Latinos, were killed in Maryland after being struck by a speeding car. So that is the kind of situation that we see all the time. And they are people who are undocumented or they have TPS, which is a legal status – they cannot qualify to become U.S. citizens.
ELLIOTT: You’re talking about temporary protected status.
TORRES: And that is, in part, the reasons why they feel these kind of challenges, because they don’t have health insurance and they are very scared to report. So that is the kind of the situation that we face in the D.C. area and beyond.
ELLIOTT: Now, in addition to the victims and their families, there must be many more immigrants among the 15,000 people who work at the Port of Baltimore, for example. How does this tragedy affect the larger immigrant community in the region?
TORRES: It’s huge. I mean, it’s a big impact. And again, it’s because the way – how we feel right now, we feel under attack. As you know, it’s a lot of attacks to the immigrant community all the time. And we are scared, and people are scared. I know that people are super scared about this, and this kind of tragic is bringing more additional pain to our community. But it’s a community who are ready to keep fighting, a community who really, really want to make a difference in this country. And we are going to keep moving forward and make sure that we are going to finally one day pass immigration reform, or at least TPS. And the President Biden had that power to be able to provide legal status for our families.

The Gateway Pundit reported last week that Joe Biden sued the most radical environmental rules in American history to phase out gasoline-powered vehicles and force customers to drive ineffective electric cars. Now, a new report has revealed the effort to finish off the gas-powered car is well-underway in eight states.
As The Daily Mail reported Tuesday, the rules being adopted in these states specify that only zero-emission vehicles, which include electric vehicles and certain plug-in hybrids, can be sold beginning with the 2035 model year. This is known as the Advanced Clean Cars II rule.
The eight states that have pledged to force their constituents to drive environmentally damaging electric vehicles are California, Rhode Island, Maryland, Massachusetts, New Jersey, New York, Oregon, and Washington. The District of Columbia has also signed off.

Unsurprisingly, California was the first to adopt the rule. They want to have 35% of new vehicle sales emit zero emissions in two years and are raising that goal to a whopping 68% by 2030.
As the California Air Resources Board notes, the rule restructures the Golden State’s “growing zero-emission vehicle market and robust motor vehicle emission control rules and augments them to meet more aggressive tailpipe emissions standards and ramp up to 100% zero-emission vehicles.”
Rhode Island was the most recent state to join the list of states pledging to ban the sale of gas-powered cars.
The Mail notes that other states have adopted versions of the Advanced Clean Cars II Rule, but have not yet pledged to wipe out gas-powered cars entirely by 2035.
Delaware and Colorado, for example, last year finalized rules that require 82 percent of all new cars to be zero emission vehicles by 2032. New Mexico announced last July that it will set its own annual targets for the sale of zero-emission vehicles. But none of these states have endorsed the 2035 ban.
The Gateway Pundit previously revealed the Biden regime, in a joint announcement with the White House and the Environmental Protection Agency (EPA), finalized a slate of economically crippling environmental regulations curbing gas-powered vehicle tailpipe emissions. These rules were ostensibly in response to greenhouse gas emissions and “climate change.”
Automakers will be forced to rapidly curb the emissions of greenhouse gases, hydrocarbons, nitrogen oxides, and particulate matter from new passenger cars, light trucks, and larger pickups and vans, beginning with the model year 2027 vehicles.
When the tailpipe emissions rules kick in, automakers will be compelled to increase production and sales of EVs, plug-in hybrids, traditional hybrids, and fuel cell vehicles. Under one “low cost” model EPA outlined in the rule, automakers must ensure 56% of light-duty car sales are battery electric and another 13% are hybrid by 2032.
With the Biden regime receiving help from several compliant states, the gas car may soon become a historical footnote unless President Trump wins this year. He is the last hope to begin reversing this environmental insanity and perhaps save America altogether.
