BREAKING: Ninth Circuit Court of Appeals Upholds California’s Ban on High-Capacity Magazines – Trump Appointed Judge Releases Video Dissent of Him Handling Firearms!

The Ninth Circuit Court of Appeals on Thursday upheld California’s ban on large-capacity magazines.

The en banc panel of the Ninth Circuit Court (a decision from the court’s entire slate of judges) sided with California’s radical Marxist Attorney General Rob Bonta.

In 2023, a federal judge struck down California’s ban on high-capacity gun magazines.

US District Judge Roger Benitez, a George W. Bush appointee, in his ruling said, “there is no American tradition of limiting ammunition capacity.” The judge said detachable magazines “solved a problem with historic firearms: running out of ammunition and having to slowly reload a gun.”

“There have been, and there will be, times where many more than 10 rounds are needed to stop attackers,” Benitez wrote, according to CBS News. “Yet, under this statute, the State says ‘too bad.’”

The judge is absolutely correct.

However, California’s radical Attorney General Rob Bonta immediately filed an appeal.

In October 2023, the Ninth Circuit granted California’s request for a stay of the district court judge’s decision.

Last year the Ninth Circuit took up another challenge to the state’s ban on high-capacity magazines.

On Thursday, in a 7-4 decision, the court’s entire slate of judges upheld the ban on large-capacity magazines.

Judge Lawrence VanDyke, a Trump appointee who grew up in Bozeman, Montana, angered a lefty judge on the court after he released a highly unusual video dissent demonstrating him handling several different firearms.

Judge Marsha Berzon, a Clinton appointee, blasted Judge VanDyke for releasing the video dissent.

“Judge Berzon pointed out two problems with Judge VanDyke’s reliance on the video: (1) The video is not part of his written dissent and it includes facts outside the record. (2) Judge VanDyke has in essence appointed himself as an expert witness in this case, providing a factual presentation with the express aim of convincing the readers of his view of the facts without complying with any of the procedural safeguards that usually apply to experts and their testimony, while simultaneously serving on the panel deciding the case,” the judges wrote in a sharp rebuke.
