The four-year-long lawfare that has been levied against Alfredo Luna, a former decorated police officer and infantry Marine, has come to an end.  The District Attorney in Riverside, California has dismissed the case that has been lingering since 2021, following the protest at the US Capitol.

While the charges were levied by the state, the investigation was initially instigated by the FBI two weeks after the events on January 6th.

The justification for the initial FBI SWAT raid?

“Pre-crime indicators” and a tweet used to obtain a search warrant by utilizing red flag gun laws.

On the morning of January 15th, 2021, at 5 am, Luna awoke to a loud bang outside of his Southern California home.  As he turned off his home alarm and checked on his young children, horrified by the loud explosion outside, his fiancé alerted him to red lasers refracting through his textured glass front door.

Then his phone rang.

“This is the FBI.  We have your home surrounded.”  Luna told his family “It’s ok.  It’s the police.  They are the good guys.”  He then told the FBI agent on the phone that he was coming outside with his hands up and alerting them to his 12- and 13-year-old daughter and son, respectively, in the home, as well as his fiancé and newborn daughter.  It was his 13-year-old son’s birthday.

In an interview with Luna, FBI whistleblower and former agent Kyle Seraphin pointed out the fact that the FBI SWAT conducted the raid at 5 am, outside federal protocol, means that they had to get permission to operate at that time and they felt “we need to get this while he’s still asleep and in bed.”

Once outside, Luna was confronted by over a dozen FBI SWAT team members and, for the first time in his life outside training as a police officer, he was placed in handcuffs.

“We have a search warrant for your home,” he was told.  Being an expert witness in matters regarding search warrants as a police officer in California, Luna asked to see the warrant.  He was told that once investigators arrived, they would show him.

His fiancée and children were ordered out of the home at gunpoint and told to sit on the sidewalk across the street.  Luna’s two month-old newborn daughter was left in the home, without familial supervision, for over an hour.

Eventually, the family was escorted back into the home while Luna was brought into the backyard, still in handcuffs and pajamas, and sat in a chair while the FBI interrogated him without legal representation, as Luna had requested.  He was told that the search warrant was obtained using California’s Red Flag gun laws based on tweets he had made being “potentially violent.”

Luna was not arrested at that time, but the FBI did take his electronic devices and firearms and left the Luna family with a house turned upside down.  Well, at least half of his home.

According to Luna, about halfway through the search, they came upon his wall of military and law enforcement awards.  The team leader said to his men, “I think this is one of the good guys.”  From then on, Luna claims his home was treated “with respect.”

The arrest would come on the night of January 20th, 2021 over possession of an AR-15 style rifle, his personally-owned service rifle as a police officer.  Keep in mind:  this firearm was not only lawfully owned and registered by Luna with documentation from the State of California, but it was also used by Luna to qualify several times as an officer.  Each time it was documented by the department, including the weapons serial number.

The bail was set at $250,000 for a non-violent crime.  Luna, in his experience as a police officer, said that he was expecting less than $40,000 as he’d seen criminals with long rap sheets have their bail set as less. The amount of $250,000 was more in line with murders and other violent crimes.

In the Declaration by Law Enforcement for Walk-Through Arrest Warrant and Order, it claims the order is “appropriate because of the following facts”:

“Luna Jr’s behavior is consistent with pre-crime indicators of extreme violence.  For example, empirical evidence shows that persons motivated by violent ideation become increasingly radicalized and move through various stages prior to violence, which includes experiencing a precipitous event that acts as a trigger to carry-out the attack.  Notably, Luna Jr. advocates violence and is an adherent of emerging domestic extremism organizations.  He has gone as far as posting messages and images of his discontent from government officials and advocates others to carry out violence…his on-line threats are extremely alarming and include allegiance to QAnon conspirators and 3-percenters militia extremists.”

Luna said that the FBI agent, during forced questioning on audio, admitted that he knew the tweets were written in a way that did not violate the law.  They also asked him what political party he was registered with and what President he voted for.

The FBI also took his K9 Training Explosive Odors from his home claiming that he did not have the ATF Permit required to carry them.  Luna insists that he kept the permits in his truck and that the permits were destroyed in order to add more charges.  Fortunately, Luna maintained the required paperwork on his cloud server as well and sent it to his attorney immediately.

The nightmare didn’t end there for Luna and his family.  It continued on for the last four years.  Luna was presented with several plea deals, including one that would have resulted in no jail time, no felony convictions, and no fines.  Essentially, they wanted a “guilty” plea so they could herald it as a victory while wiping their hands of a ridiculous prosecution.

But Luna stood his ground despite knowing that going to trial could result in him serving several years in prison.  But given his experience in law enforcement, he had already begun to poke holes in their case and expose procedural issues.

For example, the FBI stated that they obtained the Red Flag Gun Violence Protective Order based on information from a “Confidential Source”.  When Luna’s attorney filed for an in-camera hearing to reveal the source, the Riverside District Attorney’s Office instead admitted that the FBI made a mistake and that it was actually an “anonymous party,” not a confidential source, which would influence the decision to approve the warrant.

He also endured unethical engagements with the FBI, showing up at his home to return evidence despite having legal representation they should have engaged with instead.  Coincidentally, it was on the birthday of his deceased partner, August 4th, 2021.  The FBI agent who approached that day with two local law enforcement officers was told by Luna that Americans no longer trust the FBI.  When the agent asked why, Luna explained that Director Wray had lied under oath about the agency’s involvement in January 6th.  The agent replied, “Of course he said that.  He can’t say anything that will help Trump.”

Luna immediately told his attorney about the interaction and submitted FOIA requests for any body cam or audio recordings of the interaction.  None were provided.  Luna believes the recordings were destroyed.

After all the hardships Luna suffered through over four years, including his mother suffering a stroke in November 2023 and having his long-time attorney quit after Luna refused to take a plea, he was called into court on Monday, January 13th.

Much to his relief, justice was served and the charges against him were dismissed.
