An Iowa judge on Wednesday tossed Trump’s lawsuit against the Des Moines Register and Ann Selzer over a fraudulent Iowa 2024 poll that came out before the 2024 election that showed Kamala Harris ahead by 3 points.

The fraudulent poll reported during the final days of October and released just days before Election Day 2024, showed Kamala Harris, the Democrats’ presidential nominee, capturing 47% of Iowa likely voters, to Trump’s 44%.

Trump won the state with 56% of the vote to 43% for Kamala – a difference of 13 points!

The fake poll was 16 points off!

President Trump handily won Iowa in 2016 and 2020 so the poll created shockwaves just before the 2024 election.

“Likely voters in Iowa were asked: “If the general election were held today and the candidates for president were Kamala Harris for the Democrats, Donald Trump for the Republicans, Robert F. Kennedy Jr. for We the People and Chase Oliver for the Libertarians, for whom would you vote? If you already voted, for whom did you vote?”” The Des Moines Register reported.

“Likely Iowa voters in the 2024 general election have been polled four times since March 2024 about the presidential candidate they would vote for at the time. In October 2024, 47% say they would vote for or already have voted for Kamala Harris and 44% for Donald Trump,” The Des Moines Register reported.

President Trump won Iowa by more than 13 points in 2024.

In December 2024, President Trump filed a lawsuit against the Des Moines Register and its pollster, Ann Selzer, accusing them of “brazen election interference” and fraud.

Trump filed the lawsuit in Polk County, Iowa, under the Iowa Consumer Fraud Act.

An Iowa District Judge tossed the case on Wednesday.

Trump’s legal team will take the case to the Iowa Supreme Court.

A judge on Wednesday dismissed Donald Trump’s lawsuit accusing The Des Moines Register and its former pollster of misrepresenting the state of the 2024 presidential race, rejecting the president’s claim that the newspaper’s poll coverage violated Iowa’s consumer fraud law.

Calling the case extraordinary, Iowa District Judge Scott J. Beattie said that allowing the lawsuit and its “faulty” claims to proceed could have a chilling effect that “can discourage others from reporting on and debating public affairs.” He sided with pollster J. Ann Selzer and the newspaper, who described the lawsuit as a conspiracy theory and an affront to free speech protections.

Trump and his team have filed several lawsuits against media organizations accusing them of bias, calling into question the boundaries of free speech protections, particularly for the press. Some of those lawsuits have ended in settlements.

In dismissing the case in Iowa state court, Beattie wrote that Trump’s suit sought to “stretch both Iowa statutory and common law beyond their current bounds, turning speech that enjoys the highest category of First Amendment protection into a liability.” After hearing the arguments, the judge concluded the constitutional protection “is too great, and the reach is too far. The case must therefore be dismissed.”

Beattie said the case would have to be dismissed even if, solely for the purpose of deciding the motions, he accepted the Trump team’s allegations that the poll was intentionally skewed and its results fabricated. “Even with this assumption, each of the three counts still fails,” the judge wrote, because the lawsuit did not meet the legal requirements for fraud or consumer deception. He made clear that the poll and coverage of it are constitutionally protected political speech and not a commercial product.

An Idaho sheriff’s office believes that a man who died in a Boise church 44 years ago could be linked to the 1982 case in which several people were killed after taking tampered Tylenol.

The Ada County Sheriff’s Office said that a man who killed himself inside a Boise Catholic church was Dr. Mathew Betkouski, according to a news release. When the man was found in December 1982, he had no ID, only a large amount of cash and a typed letter with a false name.

Sheriff’s office cold case Detective Tim Cooper began looking at the case in 2019. He determined through photos and DNA that a Florida man who disappeared in 1982 and Betkouwski were one and the same.

Betkouski, who had worked in two drugstores in college, had discussed the use of cyanide to kill without being detected.

The 1982 Tylenol killings involved cyanide being substituted for the medicine in several Tylenol capsules. Seven people were killed in the Chicago area before the product was pulled from shelves.

Dr. Park Dietz, a forensic psychiatrist, said that by 2021, he believed Cooper was making connections that linked Betkouski to the Tylenol case.

More details will be released on the “Unsolved Mysteries” TV series episode titled “Unmasking the Tylenol Killer.”  The show will appear Oct. 9 on The Roku Channel.

Terry Dunn-Meurer, director of the show, said it includes “ never-before-seen evidence about this new possible suspect in the Tylenol murder case.”

“Mathew Betkouski lived in five states over the course of his life — California, Texas, New Mexico, Ohio and Florida,” Cooper said. “We’re hoping that getting his story out generates new leads, not just for this case, but for others we may not even know about yet. I’m especially interested in learning more about his movements between Oct. 15 and Dec. 4, 1982.”

Cooper said Betkouski was a brilliant man, but he struggled to connect with people in life, according to the Hollywood Reporter.

“Dr. Betkouski had a documented fascination with chemistry and the use of explosives from a young age, and did put others at risk on more than one occasion,” he said.

“In 1974, Dr. Betkouski sustained a traumatic brain injury, which caused some of his problems to manifest in more concerning ways than they had before,” Cooper said.

“In 1975, Dr. Betkouski worked for a flavors and fragrances company in the Jacksonville area, and after about three years, concerns mounted after co-workers reported Dr. Betkouski discussing the perfect crime and how cyanide could be used as a less messy means of taking one’s life,” he said.

Betkouski was fired by Lockheed in 1982 “following an incident at a local pharmacy,” Cooper said, in which Betkouski “attempted to obtain some type of pills or capsules … for an experiment.”

As noted by Chicago History, seven deaths were reported in the Chicago area in a short time in the fall of 1982, all from taking Tylenol in which potassium cyanide had replaced the medicine in the capsules.

No suspect has been identified. One person who came forward was later dismissed as a fraud and jailed for trying to extort money from Tylenol’s parent company.

The case led to widespread recalls of the medication, as well as regulations requiring over-the-counter medications to have tamper-evident seals.

President Trump on Wednesday responded to reports that he seeks to affix his own name to Ford’s Theater in Washington, DC, the site of Abraham Lincoln’s assassination in 1865. 

Trump called the story, first published by MS Now, “a ridiculous lie.”

Notably, MS Now is one of the three outlets that Trump banned from the White House last week, citing the “FICTION and LIES” they report.

As President Donald Trump fights to rename the Kennedy Center after himself, administration officials are circulating a list of government sites that could have his name affixed to them in some way, according to people familiar with the effort.

One landmark that has emerged in the discussions among administration officials has raised eyebrows: Ford’s Theatre, the playhouse where Abraham Lincoln was assassinated in 1865.

It is unclear how seriously the theater is being considered or how the administration would attach Trump’s name to it. One administration official said the idea had been discussed, but they didn’t know where it stood. The prospect sparked a flurry of discussion over the past week among people responsible for the historic site.

The discussions underscore how much of a priority honoring the president has become inside parts of the Trump administration — even as the Iran war nears its eighth month, diesel prices hit an all-time high, the midterm elections approach in six weeks and most Americans disapprove of the president’s job performance.

Trump responded to the report on Wednesday, calling it “FAKE NEWS” and blasting the Democrats and leftist journalists as “Degenerates and Losers who make up lie after lie.”

“Who would possibly want a name on such a tragic place? The Dumocrats suffer from serious Trump Derangement Syndrome,” Trump said.

“This Ford’s Theatre Hoax is just another one of their never-ending, malicious falsehoods to try to discredit and demean. Thank you for your attention to this matter.”

An unidentified man was arrested after shots were fired at Miami International Airport on Wednesday.

Witnesses heard multiple gunshots around 4pm ET near Door 17 on the departure level.

One witness saw a man dive behind a car after the gunshots were fired, NBC Miami reported.

Authorities closed the departure level from doors 12 to 17 and redirected traffic to the arrivals.

There were not injuries reported.

NBC Miami reported:

A man was taken into custody after gunshots at Miami International Airport triggered a massive law enforcement response Wednesday evening, authorities said.

Miami-Dade Sheriff’s Office officials said deputies responded to reports of shots fired at the airport just after 4 p.m. and took a person into custody.

The shooter fired gunshots in a parking lot, and also fired at a garbage can, officials said. It’s unclear how many shots were fired.

There were no injuries reported. Officials said they were actively questioning the subject.
