New York Refused to Honor 16,000 ICE Detainers for Illegal Aliens Involved in More Than 52,000 Crimes
October 12, 2026
New York has refused to honor 16,070 ICE detainers since President Donald Trump returned to office, releasing illegal aliens who have been accused or convicted of a combined 52,503 criminal charges, according to Department of Homeland Security data.
According to the information obtained by the New York Post, rejected detainers included people involved with 131 homicides, 132 kidnappings, 1,017 sexual offenses, 9,502 assaults, 1,776 robberies, 1,631 burglaries, 2,198 weapons infractions, 1,561 DUIs, and 4,324 drug-related counts.
ICE detainers are requests that local jails hold a suspected illegal immigrant for up to 48 hours so federal agents can take them into custody.
Local jurisdictions decide whether to honor ICE detainers.
“While sanctuary politicians continue to release dangerous criminals onto their streets, our brave law enforcement officers will continue to risk their lives to arrest these heinous criminals and make America safe again. Illegal aliens have no sanctuary in America,” DHS Secretary Markwayne Mullin told the Post.
“We enforce these laws with no help from Mayor Mamdani and Governor Hochul. The Trump Administration is committed to protecting the American people in every city and every state, and we won’t let sanctuary politicians stand in our way.”
Governor Kathy Hochul signed the Local Cops, Local Crimes Act in August, which restricted certain forms of statewide cooperation with ICE on civil immigration matters.
Hochul’s spokeswoman, Alexia Nizhny, told the Post that “New York State is not and never will be a sanctuary for violent criminals” and that, by law, the state notifies federal immigration enforcement of any non-citizen serving a state prison sentence.
Nizhny called the DHS numbers “a blatant mischaracterization of the facts meant to distract from the cruelty and violence we saw from Secretary Mullin’s ICE agents earlier this week.”
The governor’s office said about 2,000 people held in state facilities have been turned over to federal immigration enforcement under Trump.
Nizhny was referring to the shooting of illegal alien Oscar Belgal in the Bronx during a targeted arrest, during which he drove his car into two agents’ vehicles.
DHS said Belgal, a Dominican national with alleged Trinitarios ties, refused to get out of his vehicle, smashed into two government cars, and accelerated toward agents.
Belgal’s 5-year-old son was in the back seat and was not hurt.
Both Rep. Alexandria Ocasio-Cortez and Mayor Zohran Mamdani used the shooting to demand ICE leave the city and to attack the agency as “paramilitary.”
Belgal is now in federal custody.
